Pertama mari kita lihat pengertian dari Lisensi. Lisensi menurut kateglo adalah :
- (surat) izin untuk mengangkut barang dagangan, usaha, dsb: — usaha
- pajak yang harus dibayarkan untuk memperoleh surat izin, terutama tentang ekspor-impor
- izin menggunakan oktroi pihak lain dalam hukum tentang milik industri, dapat diberikan oleh si pemegang oktroi atau berdasarkan ketetapan Dewan Oktroi
dan dari wikipedia :
Lisensi dalam pengertian umum dapat diartikan memberi izin. Pemberian lisensi dapat dilakukan jika ada pihak yang memberi lisensi dan pihak yang menerima lisensi, hal ini termasuk dalam sebuah perjanjian. Definisi lain, pemberian izin dari pemilik barang/jasa kepada pihak yang menerima lisensi untuk menggunakan barang atau jasa[1] yang dilisensikan.
Jadi lisensi adalah hak pakai menggunakan jasa atau barang dagangan. Bila dikaitkan dengan lisensi perangkat lunak, maka lisensi sendiri adalah hak pakai dari perangkat lunak tersebut. Perangkat Lunak ini bisa berupa Aplikasi Web, Desktop, Mobile, Dsb.
Pengertian HAKI diambil dari wikipedia adalah:
Kekayaan Intelektual adalah pengakuan hukum yang memberikan pemegang hak (atas) kekayaan intelektual (H[A]KI) untuk mengatur penggunaan gagasan-gagasan dan ekspresi yang diciptakannya untuk jangka waktu tertentu. Istilah ‘kekayaan intelektual’ mencerminkan bahwa hal tersebut merupakan hasil pikiran atau intelektualitas, dan bahwa hak kekayaan intelektual dapat dilindungi oleh hukum sebagaimana bentuk hak milik lainnya.
Sedangkan Hak Cipta adalah satu bagian dari HAKI, pengertiannya dari wikipedia adalah :
Hak cipta adalah hak eksklusif Pencipta atau Pemegang Hak Cipta untuk mengatur penggunaan hasil penuangan gagasan atau informasi tertentu. Pada dasarnya, hak cipta merupakan “hak untuk menyalin suatu ciptaan”.
Jadi misalkan digabungkan :
Misalnya Apple’s multitouch gestures — seperti pada iPhone yang bisa menggunakan dua jari atau lebih untuk melakukan operasi tertentu. Multi Touch ini telah dipatenkan oleh Apple, sehingga tidak bisa dipakai diperangkat lain seperti Android. Dan Apple sendiri mempunyai hak cipta atas iPhone, tidak ada produk lain yang boleh menggunakan nama iPhone selain Apple kecuali atas izin Apple. Dan terakhir, Lisensi mengatur bagaimana End User bisa menggunakan iPhone tersebut, misalnya tidak boleh menjail break.
Dikaitkan dengan Salingsapa dan JCow, JCow sendiri berlisensi dobel : CPAL ( salah satu lisensi open source ) dan Commercial License. JCow yang free menghendaki aplikasi web yang dibuat berbasiskan JCow menyertakan kalimat “Powered by Jcow” di footer, sedangkan Commercial License (Yang non free) kita boleh untuk tidak menyertakan itu.
Salingsapa sendiri kabarnya membeli license JCow, maka dari itu dia boleh untuk tidak menyertakan “Powered by JCow”. Saling sapa sendiri adalah hak cipta dari Muhammad Yahya Harlan, tapi dia tidak memegang hak cipta atas Enginenya. Enginenya tetap milik JCow, dan Muhammad Yahya tidak punya hak untuk menjualnya kembali atau menginstall nya di lain mesin. Dari Commercial Licensenya Jcow :
Licensor hereby grants the Licensee a non-exclusive, non-transferable, non-assignable license to install, download and use a single instance of the Software on a single website server (“License”) through a single installation. Each License may run one instance of the Software on one domain. Any modification of the Software intended to circumvent the foregoing is prohibited and will result in revocation of the License.

-Licensee adalah pihak yang membeli lisensi, dalam hal ini adalah Muhammad Yahya Harlan.
Di sini dia juga bilang kalau dia tidak membuat engine nya, tapi dia mengembangkan.

Jadi kesimpulannya, Muhammad Yahya Harlan tidak melakukan pelanggaran hak cipta JCOW, Salingsapa merupakan hak cipta dari Muhammad Yahya Harlan, tapi Engine ( JCow ) yang digunakan oleh Salingsapa tetap milik JCow. Muhammad Yahya Harlan, hanya mempunyai lisensi untuk menggunakan JCow dan Rebranding dengan menghilangkan “Powered by Jcow”.
